Krish Heights Bhiwadi not Approved yet , Construction not started , more than 2.5 years of booking

Hi < I had booked 1 BHK flat at Krish Heights (13 floor )Bhiwadi in April 2013 . I had paid them 20 % Booking amount on May 2013 (Rs. 2.70 lacs ) . Now its being more than two and half years , construction has not started due to pending approvals (from government side ). Now they are offering me to move to other parrallel projects . I do not want to move , want my money back . I have not signed any Bulider Buyer aggrement yet . I have original allotment letter and payment receipts .

I am planning to send them legal notice , in touch with delhi high court lawyer .

Please advice .
